The Regulatory Reform (Fire Safety) Order 2005 (the Order) came into force on 1 October 2006. The Order applies to all non-domestic premises in England and Wales.

Under the Order a Responsible Person must carry out a 'suitable and sufficient' fire risk assessment and implement and maintain a fire management plan.

There have been a number of successful prosecutions for non-compliance with the order. The penalties for employers / Responsible Persons under Fire Legislation can include up to two years' imprisonment and/or unlimited fines.

Argos co-op was fined £250,000 for flouting fire regulations. The lives of staff and customers were put at risk for breaches at six stores.
